3. Use of Our Services

• Eligibility: You must be at least 18 years old and legally capable of entering into a binding agreement to use our Services.
• Account Registration: Certain parts of our Services may require registration. You agree to provide accurate, current, and complete information and to keep your account secure.
• Prohibited Activities: You agree not to use our Services for any unlawful or prohibited activities, including but not limited to:

4. Booking and Payment Terms

• Booking: When you book a sailing or boating experience, you agree to abide by the specific booking terms provided at the time of reservation.
• Payment: Payments must be made via the approved payment methods. All transactions are subject to our payment processing policies.
• Cancellation & Refunds: Cancellation policies, refund terms, and any associated fees will be outlined during the booking process. Please review them carefully before confirming your booking.

5. Refund Policy

Nauti Skipper Terms, Conditions, Cancellations, and Weather Policy Agreement

1. Reservation Acknowledgment

• I understand that Nauti Skipper provides a premium beachfront service experience.
• I agree to supply a precise beachside pickup location when booking my reservation.
• I acknowledge that once confirmed, my reservation is final under all circumstances.

2. Refund and Cancellation Policy

• I recognize that Nauti Skipper does not offer refunds for late arrivals, no-shows, parking difficulties, or inaccurate reservation details.
• I understand that any cancellation or failure to appear within 72 hours of the scheduled time will incur a charge equivalent to the cost of the booked services.
• In the event of non-payment, chargebacks, or disputes regarding funds, I agree to be responsible for any legal fees incurred during the recovery process.

3. Boarding and Ride Procedures

• I agree that all members of my party must be in waist-deep water and positioned at least 30 feet from the shore during the boarding process.
• I will ensure that all passengers are ready to board the Nauti Skipper at least 10 minutes before the scheduled departure time.
• I acknowledge that, due to possible scheduling or weather delays, Nauti Skipper may allow up to a 30-minute delay.
• I understand that every ride is guaranteed to last for a minimum of 15 minutes.

4. Conduct and Safety Standards

• I acknowledge that the captain/operator reserves the right to cancel my ride without a refund if any unsafe behavior is observed, including but not limited to:
  • Pushing or shoving
  • Standing while the vessel is in motion
  • Use of profanity or vulgar gestures
  • Intentionally jumping off the vessel
• I agree to instruct all party members to follow safety rules and the instructions of Nauti Skipper staff at all times.

5. Loading, Unloading, and Physical Requirements

• I understand that boarding and disembarking occur in waist-deep water and must be done quickly and safely to maximize ride time.
• I acknowledge that the ride requires a certain level of physical ability; if any member of my party is unable to safely load, unload, or ride, no refund will be provided.

6. Weather and Operational Adjustments

• I recognize that the custom beachfront pickup and drop-off service is provided as a luxury based on current sea conditions and is not guaranteed. In rare cases, an alternative boarding location may be used, and such changes will not warrant a refund.
• I understand that my scheduled pickup time, boarding location, and ride duration are subject to change at the discretion of Nauti Skipper staff.
• For some locations, I acknowledge that pickup requests must be approved via phone call.
• I agree that only Nauti Skipper staff may cancel a reservation due to severe weather; in these circumstances, a full refund will be issued.

By confirming my reservation, I accept and agree to the terms and conditions outlined above without reservation.

6. Intellectual Property

All content on our website—including text, graphics, logos, images, and software—is the property of Nauti Skipper or its content suppliers and is protected by intellectual property laws. Unauthorized use of any material may violate copyright, trademark, and other laws.

7. Disclaimer & Limitation of Liability

• Disclaimer: Our Services are provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.
• Limitation of Liability: In no event shall Nauti Skipper be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the Services.

8. Indemnification

You agree to indemnify and hold harmless Nauti Skipper, its affiliates, and their respective directors, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Services or any violation of these Terms.
